California Lemon Law: Top Five Defects Revealed

Leading California lemon law firm, Norman Taylor & Associates released their mid year figures for the top five lemon law defects. At the heart of every lemon law case are the defects. In a survey of recent lemon law cases the report shows the following defects to be most often associated with lemon law cases:

1. Engine defects – 34%

2. Transmission defects – 20%

3. Suspension defects – 14%

4. Fuel systems defects – 9%

5. Safety systems – 6%

“If there was a sample size of a thousand, the percentages would be strikingly similar with engine defects topping the list,” asserted Norman Taylor, who has been practicing lemon law in California since 1987.

“A more interesting observation is that once a chain of defects gets started, it seems to continue rather than being completely repaired the first time a consumer takes the vehicle in,” stated Norman Taylor, who has been practicing lemon law in California since 1987. “Very seldom is it seen where the vehicle was taken in for a first attempt to repair the engine and never taken back for the same thing.”

With over 23 years of experience practicing California lemon law, Norman Taylor & Associates has found that a very real issue that connects directly to lemon law cases is the number of poorly done or incorrectly done repairs that subsequently lead to lemon law cases. Many complaints that required repeated visits were due to the inability to duplicate the defect at the dealership. As a result, dealerships were not authorized to complete any repairs without properly diagnosing the problem. In turn, consumers were left no choice but to relentlessly take the vehicle in several times thereafter to diagnose the defect.

Once a reasonable opportunity to repair has been provided to the manufacturer or dealership acting on its behalf, consumers may be able to pursue a claim if the defect substantially impairs he use, value, or safety of the vehicle and the first repair attempt was addressed during the warranty period. The California lemon law, also known as the Song-Beverly Consumer Warranty Act was enacted to protect consumers with repetitive defects that are never properly repaired.

California Investors File Complaints Against Integrated Healthcare Holdings, Inc. and Hope to Build a Class Action Lawsuit

California Southern University Reports a 67% Pass Rate for First Time Takers of the FYLSX

Online law school releases FYLSX pass rate statistics – The California Southern University School of Law, which offers both a Juris Doctor degree and a Master of Science in Law degree, announced today its results from the latest administration of the First-Year Law Students’ Examination (FYLSX) which took place on June 22, 2010.

CalSouthern’s pass rate on the June 2010 FYLSX for first-time takers was 67%, which greatly exceeds the state’s average pass rate of 28.9% for all first-time takers of the FYLSX over the last 10 years. CalSouthern’s overall pass rate on the June 2010 FYLSX was 41%, which is higher than the 23.3% average pass rate for all takers of the FYLSX over the last 10 years. Average pass rates were calculated from data available on the State Bar of California’s website.

Passage of the FYLSX, commonly referred to as the baby bar exam, is a requirement for all non-exempt law students seeking admission to the State Bar of California.

The CalSouthern University School of Law attributes its law students’ success, in part, to its baby bar preparation workshop, which was held over the course of several weeks, three months prior to the June 2010 FYLSX. At the conclusion of the workshop, students participated in a mock baby bar exam to test their knowledge and readiness for the actual exam. “It is certainly possible to pass the baby bar examination if you take your studies seriously and start preparing very early. It is obvious that this group of law students took that advice to heart,” commented Ellen Sampong, J.D., Dean of the School of Law.

The FYLSX is administered twice per year in California. The next administration of the exam will be held on Tuesday, October 26, 2010.

How do I get a restricted license if I have a California DUI?

What is a restricted license?

A restricted license, which are sometimes called a “probationary license”, or a “work license “is authorized by California Vehicle Code section §13353.4.  A restricted license allows persons to drive ONLY for the following purposes:

to work; from work during the “course and scope” of employment; and to and from any required alcohol classes

Are you eligible for a restricted license?

Persons who refuse a breath or blood test, all commercial drivers, persons under age 21, or persons who have another DUI arrest pending are not eligible for a restricted license.

Has your license been suspended yet?

You can only get a restricted license if you’ve already suffered a license suspension.  That means that you must have had an alcohol related driving incident; and

You did not request a DMV hearing within 10 days, OR You lost a DMV hearing after requesting it.

How to get a restricted license from the DMV:

To get a restricted license after being suspended for a first time DUI, assuming you are over 21 years, you must do all of the following:

Pay DMV a re-issuance fee of 5; Show proof of financial responsibility (Form SR-22) Must be Maintained for 3 years;. This is a Department of Motor Vehicles (DMV) form, but is sent electronically from your insurance company, via computer, to the DMV.  Your insurance rates will go up. Show proof of enrollment in a DUI approved Program (AB-541 or SB-762).

If you’ve done all these things, you are eligible to get your license as soon as the mandatory suspension period ends.  The mandatory suspension period for a first time DUI is one month (30 days), to 12 months (one year) for second, third, fourth or higher DUIs.

Newport Beach is infamous for its tough DUI laws.  Not only do individuals have to deal with the court system, but once you’ve been arrested for DUI, you only have ten days to stop the DMV from taking your driving privileges away.  This is an added hassle, especially if you feel you were not guilty of a DUI.

Unfortunately, DUI checkpoints are not truly effective ways of catching criminals.  Their most useful purpose is for providing money to the city of Newport Beach, especially through impounded motor vehicles.  An individual will still have to pay to have his vehicle back, even if he has been found innocent of DUI in a court of law.

DMV Issues
