California Supreme Court Protects Consumers Against Efforts By Big Tobacco To Close The Courthouse to Class Action Lawsuits

Audet & Partners, LLP, a well known plaintiffs’ consumer law firm, noted that the Supreme Court of California recently issued a pro-consumer ruling regarding Proposition 64 and found that consumers still have the right to seek class action status under California law. The ruling, In re Tobacco II Cases, 09 C.D.O.S. 5993, was published on May 18, 2009.

At the heart of the case was whether Proposition 64, a 2004 California ballot proposition, was meant to severely limit class actions against the corporate wrongdoers. Ruling for the majority, Justice Carlos Moreno held that proposition 64 was meant to halt frivolous lawsuits and was not meant to weaken consumer protection laws, or otherwise halt class actions.
This new ruling will clarify a number of legal issues, and will reject the idea that in a class action, each and every class member will have to show “reliance” on a fraudulent act to win a class action. This will mean that the hundreds of thousands of California residents who have been harmed by tobacco companies may seek relief in court.

My silicon implants have leaked and encapsulated. I want to have them removed and would like to know if there is any money available through the “class action” suit or any other source.

Well you can find out who the Lawyer in the case was and talk to him/her and in the mean time you need them removed and the cost for that should be taken care of through that suit it will be paid back to you later once it goes through. You do need to have them taken out right away casue if not you will have to have a mastopasty later and other problems as well. You need to get to your doctor about this right away so no other problems with your body happens this is very serious and you need to have surgery again to have them taken out NOW.

Under the terms of the class action settlement of Parker v. American Medical Security, class action members will receive a combined Million in premium refunds and future credits. This class action suit challenged the methodology used by insurance companies to set renewal premiums, claiming this method was unfair and discriminatory for Georgia small business owners.

Class action members will automatically receive settlement claims forms in the mail starting the third week of October. Class action members will have to register to participate in this settlement. Many of the class action members will receive significant health insurance premium refunds and credits towards additional American Medical Security insurance products.
