In trial this week, DUI defense attorneys Darren Finebloom and AnneMarie Rizzo successfully won an acquittal on DUI charges for their client.
According to court documents, the defendant was stopped by a Sarasota Sheriff’s DUI officer at night after working a full St. Patrick’s Day holiday event at a local Irish bar establishment. The officer’s report states that he made the stop because Finebloom & Haenel’s client, traveling at 25 mph in a 30 mph zone, was proceeding too fast for road conditions, based on pedestrian traffic. The deputy’s report also noted that he observed an odor of alcohol about the defendant, bloodshot, watery eyes and slurred, groggy speech. The defendant admitted to drinking three pints of beer, but no time frame was given.
According to court documents, the officer asked Finebloom & Haenel’s client to step out of his vehicle and perform five field sobriety tests. The officer, considered a drug-impairment recognition expert as well as a member of the specialized DUI squad, believed the defendant to be impaired and a DUI arrest was made. The defendant refused the breath test, believing the machines to be unreliable, but repeatedly requested a blood test be performed to prove that he was not under the influence of alcohol.
According to court documents, at trial, the state attorney’s office argued that the defendant was impaired, based upon the field sobriety tests and the refusal of the breath test. The aggressive DUI defense attorneys Darren Finebloom and AnneMarie Rizzo argued that their client actually performed well on these tests, showing more than 50 signs of non-impairment, and was driving carefully for the conditions of the roads that evening. After final arguments, the jury left to deliberate and returned within 19 minutes with a verdict of not guilty.

The case was charged as a misdemeanor; however, the doctor’s supervisor told him in no uncertain terms, that if he suffered a conviction on any of these counts, he would lose his job. Because he was a non-citizen, he also initially faced an immigration hold (also known as an ICE hold) which meant that he was not eligible for bail.
San Jose immigration attorney Scott Mossman intervened and successfully got the ICE hold lifted, allowing the client to be released from custody. I blew a .11 with dentures that I had done has a immediate denture procedure. After a month they where ready for a reline and where very lose trapping food and liquid causing a higher BAC! I have done test with a $ 150 breathalyzer by swishing beer in my mouth spit it out and wait 20 mins and I blow up to .06. I am not trying to get out of my DUI but I know how much I had to drink and it does not match up with BAC calculator I should have been blowing around .04. My DUI happend in California.
Why do all lawyers say that they can use that for a defense!

There is NO possible way that you can know what your BAC is based on what you drank. There are many variables and factors. The same drink can have vastly different effects.
As for your question…no. If you try to go into court and say “it’s because of the alcohol in my dentures”, they will laugh you our of court.
