The Arizona immigration law just passed and signed into law by a Republican Governor (SB1070) makes being in the state of Arizona without a visa to be in the United States a misdemeanor.
This is called “Racist” by the left’s echo Chamber.
Federal law, which President Obama ( a leftist) swore to uphold when he took the oath of Office makes the same crime a felony…..
Why is this not being decried as “racist” by the left’s echo chamber?
***My initial reaction to the law was to think that some cops will use the new law as an excuse to racially profile Hispanics. this may well happen, but those cops should be dealt with in accordance with the law, just like foreign nationals who decide to immigrate here illegally.
I have read the law and it seems to be very carefully crafted to withstand 4th amendment challenges in court, and it is also very restrictive as to what circumstances must be met before anyone can be asked for “their papers”.
For this reason, I am supporting the law.
However, Former Supreme Court Justice Sandra Day O’Connor makes a valid point that Arizona may be over reaching it’s constitutional mandate in that border security is a constitutionally mandate for the Federal Government, and not the States…
If the court decides that she is right, then I would support the Supreme court overturning this law.
I would also support State’s Attorneys Generals of the various states in a suit to force the Federal government to actually do its job and secure the borders.

A federal judge dealt a serious rebuke to Arizona’s toughest-in-the-nation immigration law on Wednesday when she put most of the crackdown on hold just hours before it was to take effect. The ruling by US District Judge Susan Bolton shifts the immigration debate to the courts and sets up a lengthy legal battle that may not be decided until the Supreme Court weighs in. Republican Gov. Jan Brewer said the state will likely appeal the ruling and seek to get the judge’s order overturned. But for now, opponents of the law have prevailed: The provisions that most angered opponents will not take effect, including sections that required officers to check a person’s immigration status while enforcing other laws. The judge also delayed parts of the law that required immigrants to carry their papers at all times, and made it illegal for undocumented workers to solicit employment in public places — a move aimed at day laborers. In addition, the judge blocked officers from making warrantless arrests of suspected illegal immigrants. “Requiring Arizona law enforcement officials and agencies to determine the immigration status of every person who is arrested burdens lawfully-present aliens because their liberty will be restricted while their status is checked,” Bolton, a Clinton appointee, said in her decision. The ordinance prohibits discrimination by denying service to someone because of their heritage or origin. Vento stated that the signs are directed at the Mexican immigrants in the surrounding neighborhood. Vento feels that immigrants should be forced to learn the language of the country as opposed to having the culture adapt to them.
While there is no shortage of opinions on the issue, no one can deny the growing need for business to be able to adapt and service the bilingual market. With Congress and the White House not inclined to take on immigration reform this year, a growing number of states may attempt to duplicate Arizona’s controversial new immigration law.
“Although the once volcanic immigration debate had cooled slightly while Congress tackled the massive economic stimulus and health care campaigns, tensions have been slowly re-building for months” reports State Net Capitol Journal’s Rich Ehisen. “Almost as soon as the health care bill was done, immigration reform advocates began pressing [President] Obama and Congress to take action sooner rather than later.”
But while Obama had vowed to tackle immigration reform during his election campaign, once the health bill passed he and Congressional leaders turned their sights toward financial reforms for Wall Street. The president has since said immigration reform is off his agenda for this year.
In light of Obama’s declaration, lawmakers in a handful of states have already stated their intent to introduce similar bills, potentially allowing immigration to overtake the economy as the main issue of this fall’s elections.

Crime statistics don’t support rationale behind Arizona immigration law
“Border violence and crime due to illegal immigration are critically important issues to the people of our state,” Arizona Gov. Jan Brewer said at the signing of the controversial bill, SB 1070. “There is no higher priority than protecting the citizens of Arizona. We cannot sacrifice our safety to the murderous greed of the drug cartels. We cannot stand idly by as drop houses, kidnappings and violence compromise our quality of life.”
Yet, a look at statistics from the U.S. Customs and Border Protection agency and the FBI indicate that both the number of illegal crossers and violent crime in general have actually decreased in the past several years.
According to FBI statistics, violent crimes reported in Arizona dropped by nearly 1,500 reported incidents between 2005 and 2008. Reported property crimes also fell, from about 287,000 reported incidents to 279,000 in the same period. These decreases are accentuated by the fact that Arizona’s population grew by 600,000 between 2005 and 2008.
According to the nonpartisan Immigration Policy Institute, proponents of the bill “overlook two salient points: Crime rates have already been falling in Arizona for years despite the presence of unauthorized immigrants, and a century’s worth of research has demonstrated that immigrants are less likely to commit crimes or be behind bars than the native-born.”
