Consumer Class Action Filed Amidst Largest Pet Food Recall in U.S. History

Yesterday, the law firms Wexler Toriseva Wallace LLP and Kershaw Cutter & Ratinoff LLP filed the first California class action complaint amidst the largest pet food recall in U.S. history. The lawsuit was filed on behalf of consumers nationwide, alleging that Menu Foods, Inc., Menu Foods Income Fund, and Menu Foods Midwest Corp. (“Menu Foods”) manufactured and sold poisoned pet food products, and failed to inform customers that these products were toxic, and potentially lethal, to their pets. The lawsuit seeks recovery of all financial loss associated with the recall, including veterinary bills and food replacement costs. The class action complaint was filed in Los Angeles federal court (Case No. CV 07-01958 GHK (AJWx).
Menu Foods has recalled approximately 60 million containers of pet food and close to 100 different brands of “cuts and gravy” (pet food consisting of pieces of meat in gravy) style dog and cat food, including popular labels such as Iams, Eukanuba, and Science Diet. The lawsuit alleges that pets eating Menu Foods products have been stricken with severe kidney disorders and have demonstrated symptoms such as dehydration, diarrhea, loss of appetite, increased thirst, lethargy, and vomiting. Many pets have died. The lawsuit further alleges that pet owners around the country have spent as much as several thousand dollars each in veterinary expenses to treat their pets, sometimes over multiple visits, for illness relating to kidney failure. Still other pet owners have incurred additional costs relating to the death of their pets, including costs for euthanasia, burial, and cremation.
The complaint alleges that significant harm to pets and the expenses incurred by their owners could have been avoided had Menu Foods been more diligent and taken more responsibility for informing the public and regulatory agencies about the dangers associated with its products. The lawsuit alleges that consumers informed Menu Foods that its products were harmful to pets , and potentially lethal, as early as late-February. Yet, the complaint alleges Menu Foods responded to these concerns by first conducting its own tests, waiting until as many as 1 in 6 animal subjects had died – seven animals – before informing the Food and Drug Administration (FDA) of its findings and announcing a nationwide recall to the public.
The lawsuit alleges that since announcing the recall, consumers have been unable to reach Menu Foods’ customer representatives over advertised toll free numbers. Instead, many customers are getting busy signals and message recordings.
According to Mark J. Tamblyn, a partner in Wexler Toriseva Wallace’s Sacramento office, “thousands of consumers are frantically seeking medical attention for their pets, and many pets have died. So far, Menu Foods’ management of the crisis has been ineffective. Our firm is dedicated to ensuring an adequate response by the company, and obtaining relief for consumers.”
Veterinary professionals are recommending that all animals known to have ingested recalled foods be examined immediately. The law firms are also urging consumers who possess recalled food or suspect their pet has consumed any of the recalled food to consider the recommendations recently provided by the American Veterinary Medical Association (AVMA). Nations largest class action lawsuit certified against Wal-Mart

As many as 1.6 million current and former female employees of Wal-Mart Stores Inc. may be represented by the class action lawsuit that was certified by a federal judge for sex discrimination. The largest private civil rights case in U.S. history, the suit alleges Wal-Mart created a system that pays its female workers less than males in comparable jobs, as well as passing women for key promotions on a frequent basis.
The U.S. District Judge Martin Jenkins took nine months before deciding if the class action lawsuit should be expanded to include all women who work or have worked at Wal-MartÂs 3,500 stores nationwide since 1998. Three years prior, when the lawsuit was first filed, Wal-Mart tried to limit the parameters of the ruling. In September, Wal-Mart company attorneys claimed Wal-Mart stores operate with so much autonomy that mini-class action lawsuits targeting each outlet would be more appropriate.
Jenkins ruling was based on the 1964 congressional act passed during the civil rights movement that prohibits sex discrimination. The Judge also believed the plaintiffs presented sufficient anecdotal evidence warranting a class-action trial. The ruling could allow for the lawyers representing the women included in the class action lawsuit to pursue punitive damages, back pay, and other compensation.
So far, the Wal-Mart case has already generated 1.25 million pages of evidence and 200 sworn depositions. Wal-Mart plans on appealing the ruling, and no trial date has been set. Wal-Mart is the nationÂs largest private employer.

This is a class action for, well, almost everyone who has a pulse.
No, this isn’t a press release about a class action our law firm has filed. Yes, we are class action attorneys, and class action lawyers in California. Yes, we do class actions. But this one is the one that we simply think about whenever we hear more about the global financial market meltdown.

So now we have the basis for the identifiable class. As a class action attorney in California, this is what you look for. It’s basically anyone who has lost money on real estate or in the stock market around the world.
Add to that, everyone in the world who will now painfully be hit with a lesser way of life filled with rising oil prices due to the lower value of their currencies, fewer jobs, less government services, less valuable pensions, and just for the heck of it, higher prices for a latte or cappuccino. For anyone married, you can add more family arguments about money. For anyone single, less opportunities to meet someone because no one has any money to go out. And if you do have a date, how romantic is that fast food meal going to be since you can’t afford to take someone or be taken to a steakhouse?
Now that all we can afford is fast food and macaroni and cheese, we can also add our shorter life spans, having to buy larger sized clothes, less self esteem, poorer health and rising health costs.
I think I’m safe to say that the damages for this class action are up to at least a quadrillion zillion dollars in damages. A dream case for a California class action lawyer.
